Refund policy

Effective Date: September 13, 2026

This Return & Refund Policy applies to merchandise purchased directly from Hat Theory.

IMPORTANT — ALL SALES ARE FINAL

ALL HAT THEORY PRODUCTS ARE SPECIALTY SEASONAL HALLOWEEN MERCHANDISE AND ARE FINAL SALE.

Except for the limited circumstances expressly described below, Hat Theory does not accept returns or exchanges and does not provide refunds for change of mind, buyer's remorse, fit preference, no longer needing the merchandise, event cancellation, or Halloween having passed.

Please carefully review all product information, photographs, descriptions, sizing information, shipping estimates, and order details before purchasing.

Final-sale status does not eliminate any remedy that applicable law requires Hat Theory to provide for legitimately damaged, defective, incorrect, missing, materially nonconforming, or undelivered merchandise.

1. Final Sale

Hat Theory does not accept ordinary returns for:

  • change of mind;

  • buyer's remorse;

  • dislike of the product;

  • personal preference;

  • ordinary fit preference;

  • deciding that the item is too loose, too tight, too long, or too short when it otherwise conforms to its advertised description;

  • ordering the wrong product after fulfillment has begun;

  • purchasing more items than needed;

  • no longer needing the costume;

  • an event, party, trip, or celebration being canceled;

  • inability or decision not to attend an event;

  • another costume becoming preferable;

  • Halloween having passed;

  • deciding not to use the merchandise;

  • failure to use the merchandise;

  • receiving the product later than a customer's personal preferred date where Hat Theory otherwise satisfied its applicable shipping obligations; or

  • any other ordinary change-of-mind reason.

Final-sale merchandise does not become returnable merely because it remains unopened, unused, or unworn.

2. Exceptions to Final Sale

Final-sale status does not prevent customers from submitting a claim where merchandise is legitimately:

  • materially damaged before or during delivery;

  • materially defective;

  • the wrong item;

  • missing an item or component;

  • materially different from what was ordered;

  • materially inconsistent with the product description provided at the time of purchase;

  • lost in shipment; or

  • otherwise subject to a refund, replacement, cancellation, or remedy required by applicable law.

Submitting a claim does not automatically mean the claim has been approved.

Claims may be investigated and must satisfy the documentation and eligibility requirements below.

3. No Exchanges

Hat Theory does not offer ordinary merchandise exchanges.

Because our products do not have ordinary size or color variations, customers cannot exchange merchandise based on preference or fit.

If an approved damaged, defective, incorrect, missing, or materially nonconforming item claim is resolved through replacement, Hat Theory may process the original claim and create a separate replacement order.

Replacement merchandise is subject to availability.

4. One-Size-Fits-Most Product

Our outfit is sold as an adult one-size-fits-most product.

“One size fits most” does not mean that the garment is guaranteed to fit every body type, body proportion, height, weight, or personal fit preference.

Customers are responsible for reviewing all available product descriptions, photographs, measurements, and sizing information before purchasing.

A customer deciding that a properly described one-size-fits-most product is tighter, looser, longer, shorter, or otherwise fits differently than personally preferred does not by itself make the merchandise defective.

Ordinary fit preference is not grounds for a return or refund.

5. Material Sizing or Description Discrepancies

If you believe that the merchandise materially differs from an objective size, dimension, or specification advertised by Hat Theory, you may submit a claim.

We may request reasonable documentation such as:

  • photographs of the garment laid flat;

  • measurements taken using a ruler or measuring tape;

  • photographs clearly showing the measurement being taken;

  • photographs showing the relevant portion of the garment; and

  • other evidence reasonably necessary to compare the actual merchandise with the advertised specifications.

Where reasonably necessary to evaluate the claim, we may also request photographs from multiple angles showing how the garment fits when properly worn.

Do not submit nude, intimate, sexually explicit, or unnecessarily revealing photographs.

Only images reasonably necessary to demonstrate the claimed issue should be submitted.

6. Inspect Your Order Immediately

Customers should inspect merchandise immediately after delivery and before wearing, washing, altering, or using it.

Opening the package solely to inspect the merchandise does not prevent a legitimate damage, defect, incorrect-item, or missing-item claim.

If you discover a potential problem, stop using the merchandise and preserve:

  • the product;

  • all tags;

  • accessories and components;

  • product packaging;

  • shipping bag, mailer, or box;

  • shipping label; and

  • any other materials relevant to the claim.

Do not discard these materials until your claim has been resolved.

7. Three-Day Claim Deadline

Apparent damage, defects, incorrect merchandise, missing merchandise, missing components, and other visible fulfillment errors must generally be reported within 3 calendar days after confirmed delivery.

Contact:

help@thehattheory.com

Prompt reporting is required so that Hat Theory can document the condition of the merchandise and, where necessary, pursue a claim with our fulfillment provider or shipping carrier.

Failure to report an apparent issue within this period may result in denial where the delay materially prevents us from verifying the condition or cause of the problem.

Nothing in this Policy shortens or eliminates a legal right or warranty period that applicable law does not allow us to shorten.

8. Merchandise Delivered on October 31

If merchandise is delivered on October 31, visible damage, defects, incorrect merchandise, or missing-item issues should be reported immediately after opening and before the merchandise is worn or used.

Where reasonably possible, apparent issues should be reported on October 31.

This requirement helps distinguish legitimate delivery-condition claims from damage or wear occurring after use of the costume.

It does not eliminate any remedy required by applicable law or prevent consideration where immediate reporting was not reasonably possible.

9. Documentation for Damaged, Defective, Incorrect, or Missing Items

Claims must include sufficient evidence for Hat Theory to reasonably investigate the issue.

We may require:

  • order number;

  • detailed written description of the issue;

  • clear photograph of the complete front of the product;

  • clear photograph of the complete back of the product;

  • clear photographs of each relevant side or angle;

  • close-up photographs of the alleged damage or defect;

  • full-item photographs showing the condition in context;

  • photographs of all sides of the shipping bag, mailer, or box;

  • photograph of the shipping label;

  • photographs showing any damage to external packaging;

  • photographs of internal packaging where relevant; and

  • other documentation reasonably necessary to determine what occurred.

When an issue is visible upon opening, photographs should be taken before the merchandise is worn or used.

10. Authentic Claim Evidence

All photographs, videos, measurements, statements, documents, and other information submitted with a claim must accurately depict the actual product and circumstances involved.

Evidence may not be fabricated, materially manipulated, deceptively edited, or generated or modified using artificial intelligence in a manner that falsely depicts:

  • damage;

  • defects;

  • fit;

  • measurements;

  • packaging condition;

  • missing merchandise; or

  • any other fact relevant to the claim.

Where we reasonably identify inconsistencies or evidence of manipulation, we may request:

  • original image files;

  • additional photographs;

  • photographs from different angles;

  • additional measurements;

  • video;

  • packaging evidence; or

  • other reasonable documentation.

A claim may be denied where reliable evidence establishes that material evidence was fabricated or deceptively altered.

Normal automatic image processing performed by a phone or camera does not by itself constitute fraudulent alteration.

11. Continued Use After Discovering a Problem

If an apparent defect or damage is discovered before the merchandise is worn or used, the customer should not continue using the product merely because an event is approaching.

Continued use after discovering an apparent issue may affect our ability to determine whether the problem existed when the product was delivered.

A claim may be denied where reliable evidence establishes that the condition resulted from:

  • wearing or use;

  • misuse;

  • customer alteration;

  • washing or cleaning;

  • customer-caused damage; or

  • another event occurring after delivery,

rather than a defect or damage existing when the item was delivered.

Nothing in this section eliminates a remedy required by law for legitimate defective merchandise.

12. Conditions That Are Not Ordinarily Defects

The following ordinarily do not constitute defects unless the merchandise materially differs from what Hat Theory represented:

  • ordinary manufacturing tolerances;

  • minor color differences caused by photography, lighting, or screen displays;

  • minor dimensional variations;

  • personal fit preference;

  • wrinkles caused by folding, packaging, or transportation;

  • characteristics clearly disclosed in product descriptions or photographs;

  • damage occurring after delivery;

  • damage caused by improper use;

  • customer alterations;

  • damage caused by improper cleaning or washing; or

  • ordinary wear.

13. Claim Review

Submission of photographs or other evidence does not guarantee claim approval.

Hat Theory may review information including:

  • the merchandise;

  • photographs and videos;

  • packaging condition;

  • order records;

  • fulfillment records;

  • tracking information;

  • carrier records;

  • manufacturing specifications;

  • measurements; and

  • other information reasonably relevant to the claim.

We may also request information from NextSmartShip, manufacturers, shipping carriers, or other parties involved in fulfillment.

14. Remedies for Approved Claims

If Hat Theory determines that merchandise was materially defective, damaged before or during delivery, incorrectly fulfilled, materially nonconforming, or missing because of an error attributable to Hat Theory or its fulfillment process, we will provide an appropriate remedy.

Depending on the circumstances, available inventory, and applicable law, this may include:

  • replacement;

  • refund;

  • replacement of the affected component;

  • refund of the affected component; or

  • another appropriate remedy.

Where applicable law permits Hat Theory to select among reasonable remedies, we may determine the appropriate remedy.

Where applicable law gives the customer the right to select a particular remedy, that law controls.

15. Replacement Merchandise

An approved replacement is not an ordinary exchange.

When replacement is approved, Hat Theory may process the original claim and create a separate replacement order.

Replacement inventory is not guaranteed.

If replacement merchandise is unavailable and a refund is appropriate or required, Hat Theory will issue the applicable refund.

16. Return Authorization Required

Some approved claims may be resolved without requiring merchandise to be physically returned.

If Hat Theory requires the merchandise to be returned, we will provide written return authorization and instructions.

DO NOT RETURN MERCHANDISE WITHOUT FIRST CONTACTING HAT THEORY AND RECEIVING WRITTEN RETURN INSTRUCTIONS.

Do not send merchandise directly to:

  • our Fairfield, New Jersey business address;

  • NextSmartShip;

  • a manufacturer;

  • a carrier;

  • a warehouse; or

  • any other address

unless our customer-service team specifically instructs you to do so in writing.

Unauthorized returns may be refused, unidentifiable, lost, returned to sender, or subject to additional costs.

17. Return Shipping for Approved Claims

If Hat Theory requires the return of merchandise because of an approved defect, damage claim, incorrect-item claim, missing-item issue, or other error attributable to Hat Theory or its fulfillment process, Hat Theory will arrange or cover required return shipping where appropriate.

Customers will not be charged an ordinary return-label fee for merchandise Hat Theory requires to be returned because of an approved problem for which Hat Theory is responsible.

Because Hat Theory does not accept ordinary change-of-mind returns, there is no general customer-paid return program.

18. Inspection of Returned Claim Merchandise

Return authorization does not necessarily constitute final claim approval where physical inspection is reasonably necessary.

Returned merchandise may be inspected to verify the claimed issue.

Inspection may consider:

  • consistency with submitted photographs;

  • signs of wear;

  • stains;

  • odors;

  • washing;

  • alterations;

  • customer-caused damage;

  • missing components;

  • substituted merchandise;

  • product identifiers; and

  • other physical evidence relevant to the claim.

If inspection establishes that the alleged defect was not present and that damage resulted from customer use, alteration, or another excluded circumstance, the claim may be denied to the extent permitted by law.

19. Lost Shipments

A package believed to be lost may require investigation by the applicable shipping carrier, NextSmartShip, and Hat Theory before a refund or replacement decision is made.

Carrier investigations can take time and may be outside Hat Theory's direct control.

A shipment is not necessarily considered lost merely because tracking temporarily stops updating or delivery is delayed.

Customers may be required to provide reasonable cooperation or documentation requested as part of the investigation.

If a carrier or fulfillment provider confirms that a shipment is lost, Hat Theory will provide an appropriate remedy.

20. Packages Marked Delivered but Not Received

A carrier status of “Delivered” does not automatically result in a refund.

Claims involving packages marked delivered may require investigation and review of:

  • tracking information;

  • delivery scans;

  • delivery photographs;

  • GPS or carrier location information where available;

  • the customer-provided address;

  • carrier investigation results; and

  • other relevant evidence.

If reliable evidence establishes that the package was lost or misdelivered, Hat Theory will review the appropriate remedy.

If reliable evidence establishes delivery to the address provided by the customer, a refund may be denied except where applicable law requires otherwise.

21. Customer Address Errors

If Hat Theory ships an order to the exact address entered by the customer and the shipment cannot be delivered because the address was incorrect, incomplete, inaccessible, or otherwise unsuitable, resulting expenses may be the customer's responsibility to the extent permitted by law.

These may include actual:

  • address-correction fees;

  • return-to-sender costs;

  • redelivery fees;

  • return freight;

  • carrier fees; and

  • warehouse handling charges.

A customer-provided address error does not convert final-sale merchandise into returnable merchandise.

22. Refused and Unclaimed Deliveries

Refusing delivery does not constitute a return or cancellation.

Customers should not refuse a package unless Hat Theory has specifically provided written authorization to do so.

Where a customer voluntarily refuses, abandons, rejects, or fails to claim a deliverable shipment without our prior written authorization, the customer may be responsible, to the extent permitted by law, for:

  • actual return freight charges;

  • return-to-sender charges;

  • additional carrier charges;

  • warehouse or return-processing charges;

  • storage or holding fees actually assessed;

  • demurrage actually assessed where applicable;

  • redelivery expenses; and

  • a 20% restocking fee based on the merchandise purchase price.

These amounts may be deducted from any refund that Hat Theory is otherwise legally required or chooses to provide.

The 20% restocking fee does not apply to an approved defect, damage, incorrect-item, missing-item, or fulfillment-error claim where Hat Theory directs the customer to return the merchandise.

Hat Theory will not charge fictitious or speculative carrier, storage, demurrage, or warehouse fees. Any pass-through fee must represent a cost actually assessed or incurred.

23. Refunds Are Limited to Approved Exceptions

Because Hat Theory merchandise is final sale, Hat Theory does not provide refunds for ordinary return requests after merchandise has entered fulfillment or been shipped.

Refunds may nevertheless be issued where:

  • a preorder or other eligible order is successfully canceled in accordance with our Purchase Options Cancellation Policy;

  • an order placed on or after October 1 is successfully canceled before fulfillment begins;

  • Hat Theory approves a damage, defect, incorrect-item, missing-item, lost-shipment, or materially nonconforming merchandise claim for which a refund is an appropriate remedy;

  • Hat Theory is unable to provide the ordered merchandise;

  • applicable shipping law requires cancellation or refund;

  • a shipment is confirmed lost and refund is the selected remedy;

  • another provision of this Policy expressly provides for a refund; or

  • applicable law otherwise requires one.

A customer's submission of a cancellation request does not itself guarantee cancellation. Where cancellation depends on stopping fulfillment, Hat Theory must confirm that the order was successfully canceled.

24. Refund Method

Approved refunds are ordinarily issued to the original payment method only.

Hat Theory does not ordinarily issue cash, checks, or substitute store credit in place of refunding the original payment method unless the original method cannot reasonably be refunded or applicable law requires otherwise.

25. Shipping Charges and Approved Claims

Where Hat Theory is responsible for materially defective, damaged, incorrect, missing, or otherwise nonconforming merchandise and applicable law requires reimbursement of shipping charges, Hat Theory will provide the required reimbursement.

Ordinary shipping charges are not separately refundable merely because a customer changes their mind or no longer wants final-sale merchandise.

26. Refund Processing Time

Where merchandise must be physically returned, refund processing begins only after the merchandise reaches the designated return facility and any necessary inspection has been completed.

Inspection may ordinarily require approximately 3–5 business days after receipt.

Transportation disruptions, holidays, unusual claim volume, operational issues, or other circumstances outside our reasonable control may affect inspection timing.

Once a refund is approved, Hat Theory generally submits the refund to the original payment method within approximately 5 business days, unless applicable law requires a shorter period.

After Hat Theory submits the refund, the customer's bank, card issuer, payment processor, or other financial institution may require additional time to post the credit.

Financial-institution posting times are outside Hat Theory's control.

27. Fraudulent Claims and Abuse

Hat Theory reserves the right to investigate suspected:

  • refund fraud;

  • return fraud;

  • delivery fraud;

  • fabricated defects;

  • false missing-item claims;

  • merchandise substitution;

  • alteration of merchandise;

  • manipulated photographs;

  • AI-generated false evidence;

  • falsified measurements;

  • fabricated tracking allegations; and

  • other materially deceptive conduct.

We may request reasonable additional information where necessary to investigate a claim.

A claim may be denied where reliable evidence establishes fraud or material misrepresentation.

28. Legitimate Consumer Rights

Hat Theory will not deny a legitimate claim merely because a customer:

  • complains about a product;

  • contacts a consumer-protection agency;

  • disputes an unauthorized transaction;

  • seeks assistance regarding an order; or

  • exercises a non-waivable consumer right.

Our fraud and documentation procedures are intended to identify materially false or deceptive claims, not prevent legitimate claims.

29. Seasonal Nature of Merchandise

Hat Theory merchandise is specialty seasonal Halloween merchandise.

The fact that:

  • Halloween has passed;

  • an event was canceled;

  • the customer changed plans;

  • another costume was selected;

  • the merchandise was never used; or

  • the customer no longer needs the merchandise

does not create a right to return final-sale merchandise.

This does not limit remedies required because of an actual defect, fulfillment error, shipping-law violation, or another right that applicable law does not allow us to waive.

30. Rights Required by Law

Nothing in this Policy is intended to waive, restrict, or eliminate a consumer-protection right, warranty, cancellation right, refund right, or other remedy that applicable law does not permit Hat Theory to waive.

Where applicable law conflicts with this Policy, applicable law controls.
